The law’s main purpose is to protect car buyers again the defective car sold by the manufacturer. This law won’t let the manufacturer or dealer escape. So let’s understand the lemon car law.

    The only thing that is required is that people must have purchase the car from retailer or dealer not from an individual. This happens only when there is a significant manufacturing defect. Apart from this if the damage cannot be resolved or repair then the dealer might need to give a new vehicle to the customer. Apart from this the dealer or manufacturer must pay the fees of attorney. In some of the cases dealer might also need to pay civil penalties if they try to break the conditions under lemon law. 

    What happens if the car is found to be a lemon?

    Suppose you find that your vehicle is a lemon, as per the law of California. The dealer might need to refund all of your money, or they can also replace it with another one. As per the law, the consumer or the user can decide if they want to get a replacement or a refund. Make sure that if you choose the Refund option, the manufacturer has the right to deduct some amount. This is done based on mileage. There are three different warranties:

    • Warranty of used car

    The law is only applied to vehicles having a warranty. You cannot file a complaint against the dealer if the warranty is over. But if you still have the warranty, it’s your right to get back the money you have paid. Apart from this, the dealer’s manufacturer will also have to give a warranty from their side. 

    • Implied warranty

    When the dealer sells your car, there is an implied warranty of merchantability. This warranty is an unwritten promise to the customer that the car will work properly. So once you get the used vehicle and find out it helps a defect, the dealer has violated the warranty. 

    • Service contract and Extended warranty

    Sometimes the manufacturer provides an extended warranty which is a service contract. The extended warranty is the type of contract which means that if anything happens with the vehicle, all the repairs will be covered. But it is far more different than the manufacturer’s warranty. So before you buy a used vehicle, look for the vehicle’s guide and check if it comes with a warranty.

    Do manufacturers have the right to fight against the law?

    Manufacturers are bound to provide a refund or replace the vehicle with the user if the car does not work well. People file a case under lemon car law when the replacement cannot be done. But when the customer asks for a refund due to a small defect, then there are chances that the flight may arise between the consumer and manufacturer.
